1. Agreement to Terms
By purchasing any product, service, or package from Apex Web, you ("the Client") agree to these Terms & Conditions. These apply to all services offered by Apex Web.
2. Pricing & Payment
All prices are clearly displayed on our website and must be paid upfront or according to an agreed payment plan.
Once payment is made and work has started, the Client agrees that no refunds will be issued.
Payment signifies the Client's full acceptance of these Terms & Conditions.
3. No Refund Policy
Apex Web upholds a strict No Refund Policy on all services and packages.
Once work begins or payment is processed, refunds will not be granted under any circumstances.
By proceeding with payment, the Client confirms their understanding and acceptance of this policy.
4. Third-Party Software
Apex Web uses third-party tools and software, including but not limited to Aerafy.co, to provide certain services.
We have no control over third-party platforms and cannot guarantee their availability or performance.
Apex Web will not be liable for any disruptions, losses, or issues arising from third-party failures, including those from Aerafy.co.
No refunds, credits, or compensations will be provided due to third-party service outages or discontinuations.
5. Cancellations
For services on recurring payment plans (e.g., hosting, maintenance), Clients must notify Apex Web of cancellation at least 7 days before their next scheduled payment.
Failure to provide 7 days' notice will result in the next payment being processed, and no refunds will be issued for that charge.
Cancellations must be communicated in writing via official email or through the agreed communication channel.
6. Service Delivery & Timeline
Timelines for service delivery vary depending on project scope and Client cooperation.
Clients are responsible for supplying necessary content, information, and approvals promptly to prevent delays.
7. Intellectual Property
Once full payment is completed, the Client owns the rights to their specific website design and custom content, excluding any third-party licenses, tools, or software.
Apex Web retains the right to feature completed projects in our portfolio and marketing materials.
8. Hosting, Maintenance & Renewals
Clients must ensure timely payments for hosting and maintenance services to avoid interruptions.
Upon expiry of prepaid hosting or maintenance periods, renewal is required to continue services.
Non-renewal may lead to suspension or deletion of services without further notice.
9. Limitation of Liability
Apex Web is not liable for any indirect, incidental, or consequential damages from the use or inability to use our services.
We make no guarantees regarding specific business outcomes such as traffic growth, sales, or lead generation.
10. Changes to Terms
Apex Web reserves the right to amend these Terms & Conditions at any time. The latest version will always be available on our website.
Continued use of our services constitutes acceptance of the latest terms.
11. Governing Law
These Terms & Conditions are governed by the laws of South Africa. Any disputes will be handled under South African jurisdiction.
